Supreme Court Victory on Clean Power Plan

July 1, 2022 - When it rains it pours..It seems this week the good news just keeps coming from the nation's highest court for those who value freedom and sound science.
The Supreme Court ruled that EPA exceeded its authority under The Clean Air Act when it promulgated the so-called "Clean Power Plan."
The Clean Power Plan was designed to reduce CO2 emissions by changing the way Americans generate electricity.
The problem? EPA was not only wrong in its approach, but Congress delegated it no such authority.

This is a major win.
Gina McCarthy was President Obama's EPA Administrator. Today she serves as President Biden's "climate czar." Her Clean Power Plan became a notorious example of bureaucratic overreach. It would raise energy prices and damage the economy, while having little or no meaningful impact on the temperature of the Earth. It would negatively impact our daily lives and freedoms in ways Congress never intended.
The Supreme Court voted 6 to 3 to strike it down.
Chief Justice John Roberts, writing for the court, is clear. We posted the full decision with key excerpts to CFACT.org:
“The only question before the Court… is whether the “best system of emission reduction identified by EPA in the Clean Power Plan was within the authority granted to the Agency in Section 111(d) of the Clean Air Act. For the reasons given, the answer is no.”
The message is clear. Regulatory agencies must operate within the authority granted them by law. They must not exceed that authority.
This is fundamental. Thank God we have a court that understands this clearly.
